A Raja gets bail in 2G spectrum case; Jaya, DMK react

New Delhi: More than 15 months after his arrest, former Telecom Minister A Raja was on Tuesday granted bail by a Delhi court in the case of 2G spectrum.
"The bail application is allowed," CBI Special Judge OP Saini said.
The court granted bail to DMK MP on a personal bond of Rs 20 lakh and two sureties of same amount.
Court while giving the bail conditions imposed on the Raja that he would visit Tamil Nadu without prior permission and can not go to the office of the Department of Telecom (DOT).
The court, in its 14-page bail order, Raja also said to try not influence any witness while on bail. Raja was arrested on February 2, 2011.
Reacting to the news, Tamil Nadu chief minister J Jayalalithaa said the 2G scam case begins diluted.
Meanwhile, the DMK welcomed the decision. "We welcome the decision of the court and hope that he will come out and prove his innocence," the DMK leader Tiruchi Siva said.
Asked if Raja would attend Parliament or do the work of the party, Siva said that he was part of the activities of each of the conditions laid down by the court for his bail.
Siva said that some of the DMK leader could visit the prison at the time of release of the former Minister of Telecom.
The court, while giving bail to the 49-year-old Raja, said all of the co-accused in that case granted bail and his further detention will not serve any purpose.
"At the end considering the development of the test of time, of keeping the accused and the fact that all other accused were released on bail, I am of the opinion that further detention of the accused will not serve any purpose and for that reason, I'm inclined to admit the applicant / accused (Raja) bail, "the special judge said.
The lag of the CBI that if granted bail Raja can influence and change witness evidence, the court said it addressed them by imposing conditions and restrictions on the accused.
Court noted that full documentary evidence in the case and its prevention.
"Moreover, the notion that this prosecution (that Raja could influence the witnesses and evidence to change) will be by imposing conditions and restrictions on the accused.
"Moreover, almost all documentary evidence in the case in nature and both are in custody of the court," Judge said.
Raja also direct the court to surrender his passport as a prerequisite for bail.
Raja, who remained in the judicial custody for more than 15 months since his arrest, has sought bail on the ground of similarity of the 13 other co-accused to secure bail from either the Supreme Court, the Delhi High Court or the court proceedings.
Raja has maintained the charges against him were "false and fabricated" and "not sustainable in law."
The CBI is vehemently against Raja on bail, saying that he was not drawn on the ground of parity as the charges leveled against him are of serious nature.
The agency alleged that DMK-run Kalaignar TV of Rs 200 crore received a bribe from the DB Group Shahid Balwa by a circuitous route as a payment for favors shown by Raja on spectrum allocation .The agency also claimed that during the probe, it has come to light that Raja and others have received bribe of Rs 200 crore from other specific companies under its scanner in connection with the scam spectrum.
The CBI has raised questions on Raja's alleged links with Mauritius-based Delphi Investment Ltd, Reliance Telecom Ltd. which allegedly moved its shares and said if released on bail at this stage , he may tamper with evidence.
Raja has sought bail, saying the Supreme Court, while giving bail to the former Telecom Secretary Siddharth Behura, does not recognize the case of public servants from that of others.
He submitted that he and Behura are facing similar charges of incitement, conspiracy and criminal breach of trust.
Raja advice is submitted that his client was not a minister of the Union cabinet, he can not change the evidence or influence the witnesses.
Besides Raja, his private secretary RK Chandolia, Behura, a DMK MP Kanimozhi, corporate honchos - Reliance Anil Dhirubhai Ambani group of MD Gautam Doshi, Surendra Pipara ADAG Group President and Senior Vice President Hari Nair, Unitech MD Sanjay Chandra and Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka - are facing trial in the case.
The court also put to the test Kalaignar TV MD Sharad Kumar, Director of Cineyug Media and Entertainment Pvt Ltd Karim Morani and director of Kusegaon Fruits and Vegetables Pvt Ltd Asif Balwa and Rajeev Agarwal.
Among those 14 people, three Telecom companies - Swan Telecom Pvt Ltd, Reliance Telecom Ltd and Unitech Wireless (Tamil Nadu) Pvt Ltd, is also facing trial in the case.Raja and others charged for the offense of fraud, forgery, criminal conspiracy and corruption in addition to criminal breach of trust entails a maximum penalty of life imprisonment.
